In this appeal, the Appellant is challenging the judgment of the High Court of Tanzania, which reversed the decision of the Resident Magistrate’s Court (the trial court). Before the trial court, the Appellants, were jointly and together charged with the offence of grazing cattle in the game reserve area contrary to the law. The Respondents were jointly found guilty of the offence. They were convicted and sentenced each to pay a fine of Tshs. 500,000/=, in default of which, they were to serve two (2) years’ imprisonment. In addition, all herds of cattle were forfeited to the Government. Aggrieved by that decision and the resultant orders, the Respondents successfully appealed to the High Court. The Court quashed conviction, set aside the sentences, and vacated the orders for forfeiture. Aggrieved the Appellant appealed to this Court, hence the present appeal.
