The Appellant was charged and convicted of murder contrary
to sections 196 and 197 of the Penal Code [Cap 16 R.E. 2002] by the High Court
of Tanzania sitting at Mbeya and was sentenced to death by hanging. It was
alleged that the Appellant on the 19th day of November, 2012 at
Sakamwela Village within Mbozi District, Mbeya Region, did murder one Labson
Sichizya. The prosecution fielded five witnesses to prove its case whereas on
the defence side only the Appellant testified. At the end of the trial, the
Appellant was found guilty, convicted and sentenced accordingly. Aggrieved by
both the conviction and sentence, the Appellant came to this Court on appeal.
